Welcome to Coyote Moon Design Company! By accessing this website or purchasing from us, you agree to the following Terms of Service (“Terms”). Please read them carefully before placing your order. If you do not agree to these Terms, please do not use this website.

1. General Information

This website and business are owned and operated in the State of Illinois, United States of America. These Terms are governed by and construed in accordance with the laws of the State of Illinois and applicable U.S. federal law, without regard to conflict-of-law principles. Dispute resolution and venue are addressed in Section 18 below.

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to place an order. By purchasing, you represent that you meet this requirement or are using the site under the supervision of a parent or legal guardian. This website is not directed at children under 13, and we do not knowingly collect personal information from children under 13.

2. Products & Services

All items are made-to-order unless noted otherwise. Product descriptions, pricing, and availability are subject to change without notice. We reserve the right to refuse service or cancel orders at our discretion, with a full refund issued for any prepaid canceled order. We are not responsible for typographical errors, user-submitted misspellings, or incorrect input on custom items. Please double-check all custom order details before submitting.

Product colors and appearance may vary slightly from what is displayed on your screen due to monitor settings and the nature of custom production; minor variations are not considered defects.

3. Custom Order Content Guidelines

At Coyote Moon Design Company,  we are dedicated to creating high-quality custom apparel. To ensure our work aligns with our company values and legal obligations, we reserve the right to refuse service or cancel any order at our sole discretion. Requests that will not be fulfilled include, but are not limited to, those containing:

•         Illegal Content: Any design that promotes illegal acts or substances.

•         Hate Speech & Discrimination: Content that is hateful, harassing, or discriminatory towards any individual or group based on race, religion, nationality, gender identity, sexual orientation, or disability.

•         Profanity & Obscenity: Material that is excessively vulgar, obscene, or pornographic.

•         Intellectual Property Infringement: Any logos, images, text, or designs protected by copyright, trademark, or right of publicity that you do not have the legal right to reproduce. By submitting a design, you affirm that you hold the necessary rights to use it.

•         Violent or Harmful Content: Imagery or text that promotes or glorifies violence, self-harm, or abuse.

If an order is canceled for any of these reasons, a full refund will be issued.

4. User-Submitted Designs & Indemnification

When you submit text, artwork, logos, photographs, or other content for a custom order, you retain ownership of your content but grant us a limited, non-exclusive license to use, reproduce, and modify it solely as needed to produce and fulfill your order and to communicate with you about it. We will not use your submitted designs for marketing or resale without your permission.

You are solely responsible for the content you submit. You agree to indemnify, defend, and hold harmless Coyote Moon Design Company, its owners, and its employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your submitted content, including claims of copyright or trademark infringement, violation of publicity or privacy rights, or violation of law.

5. Illinois Department of Corrections (IDOC) Items

For items related to the Illinois Department of Corrections, we may require verification of affiliation. If we request verification, you must provide it. We reserve the right to cancel the sale (with a refund) if verification is not provided or if we suspect malicious intent associated with the purchase.

6. Payment Terms

We accept payment via the authorized providers listed at checkout. Orders are not considered confirmed until full payment is received. We reserve the right to cancel unpaid or suspicious orders. All prices are listed in U.S. dollars (USD) unless otherwise stated. If you pay in another currency, your card issuer or payment provider determines the exchange rate and may charge foreign transaction fees, which are your responsibility.

We collect and remit sales tax, use tax, or similar transaction taxes where we are required to do so by applicable law, including for orders shipped to Illinois and to other U.S. states where we have a tax collection obligation. The applicable tax, if any, will be shown at checkout.

Initiating a chargeback for a legitimate, fulfilled order instead of contacting us first may result in refusal of future service. Please reach out to us directly to resolve any billing issue.

7. International Orders, Shipping & Customs

We now offer international shipping to select countries. The following additional terms apply to orders shipped outside the United States:

•         Duties & Import Taxes: Unless expressly stated and collected at checkout, international orders are shipped on a Delivered Duty Unpaid basis. You, the recipient, are the importer of record and are responsible for all customs duties, import taxes (including VAT or GST), brokerage fees, and other charges imposed by your country. These charges are not included in our prices or shipping fees, and we cannot estimate them for you.

•         Customs Delays & Refusal: We are not responsible for delays caused by customs processing. If a package is refused, abandoned, or returned because duties or taxes were not paid, refunds (if any) will be reduced by shipping costs and any fees we incur, and made-to-order items may not be refundable.

•         Accuracy of Information: You are responsible for providing a complete and accurate shipping address. We are required to declare the accurate value and contents of shipments on customs forms and will not falsify customs documentation.

•         Export Restrictions: We do not ship to countries, regions, individuals, or entities subject to U.S. trade sanctions or export restrictions, and we may cancel (with refund) any order we reasonably believe would violate U.S. export control or sanctions laws.

•         Local Law: You are responsible for ensuring that the products you order may be lawfully imported into and used in your country.

8. Consumer Rights Notice for International Customers

Nothing in these Terms limits any rights you have under mandatory consumer protection laws of your country of residence that cannot be waived by contract. Where those laws conflict with these Terms, those laws prevail for you.

Notice for customers in the European Union and United Kingdom: You may have a statutory 14-day right of withdrawal for distance purchases. However, under applicable EU and UK consumer law, this withdrawal right does not apply to goods that are made to your specifications or are clearly personalized. Because most of our products are made-to-order custom items, the withdrawal right generally does not apply to them. It may apply to non-customized, ready-made items, if offered. Your statutory rights regarding faulty or misdescribed goods are not affected.

9. Loyalty Program Rewards

Membership in our loyalty program is free and voluntary. The loyalty program may not be available to customers outside the United States.

•         No Cash Value: Points are non-transferable, have no cash value, and cannot be exchanged for cash.

•         Earning Points: Points are earned on the merchandise subtotal only, after any other discounts are applied, and before taxes and shipping fees.

•         Redemption Restrictions: Reward coupons cannot be combined or “stacked” with other automatic discounts, sale prices, or coupon codes per order.

•         Returns: If an item is returned, any points earned from that purchase will be deducted from your account balance.

•         Modifications: We reserve the right to modify, suspend, or terminate the loyalty program, including point values and reward tiers, at any time without prior notice, except where prior notice is required by applicable law.

10. SMS / Text Message Marketing Program

By providing your mobile phone number and opting in through our website (for example, at checkout or via a signup form), you give your express written consent to receive recurring automated marketing and promotional text messages (SMS/MMS) from Coyote Moon Design Company at the number provided, which may include messages about promotions, new products, sales, and order-related updates. Consent to receive marketing text messages is not a condition of any purchase.

•         Message Frequency: Message frequency varies from month to month.

•         Message & Data Rates: Message and data rates may apply. Charges are billed by your mobile carrier according to your plan.

•         Opting Out: You can cancel at any time by replying STOP to any message from us. After you send STOP, you will receive a one-time confirmation message and no further marketing texts will be sent. You may also opt out by contacting us using the information in the Contact section below.

•         Carrier Disclaimer: Mobile carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission by your carrier and is not guaranteed.

•         Eligibility: The SMS program is available only in countries where we are permitted to send marketing texts, and you must be the account holder (or have the account holder's permission) for the mobile number provided. If you reside in the United Kingdom or European Union, we will only send marketing texts where you have given consent as required by applicable law, and you may withdraw consent at any time.

•         Your Information: Your phone number and related data are collected and used as described in our Privacy Policy, including sharing with our SMS service provider solely to deliver messages. We do not sell your phone number to third parties.

If you change or deactivate your mobile number, you agree to notify us or opt out so that messages are not sent to a number reassigned to someone else.

11. Refunds, Returns & Cancellations

All policies related to refunds, returns, exchanges, and cancellations are outlined on our Refund & Return Policy page. Please review those terms carefully before placing an order. By purchasing, you acknowledge and accept the return/refund limitations, including the final-sale nature of custom-made products, except where a refund or remedy is required by applicable law (for example, for defective goods or under the mandatory consumer laws described in Section 8).

12. Intellectual Property & Licensing

All original designs, product photos, logos, and written content on this website are the property of Coyote Moon Design Company or are used under proper license or authorization. These materials may not be copied, shared, altered, or reproduced without written permission. Where digital files are sold, reproduction and usage rights are granted only as specified in the product description or licensing terms. Unauthorized use, reproduction, or distribution of our work (outside the rights granted to you as a customer) may result in legal action.

13. Privacy & Data Collection

We collect limited personal information (such as name, email, and shipping address) strictly for the purposes of processing your order, providing customer service, and complying with legal obligations. We do not sell or rent your personal data to third parties. Please see our Privacy Policy for full details, including how to exercise any rights you may have under applicable privacy laws.

Our business and servers are located in the United States. If you order from outside the United States, your personal information will be transferred to and processed in the United States, where data protection laws may differ from those in your country. We take reasonable measures to protect your information, and we honor applicable data protection rights (such as access, correction, and deletion requests) as required by the laws that apply to you.

14. Website Access & Use

You agree not to misuse or attempt to disrupt this website, including but not limited to: hacking, scraping, introducing malware, or interfering with other users' experience. Any unauthorized use of the site or its contents may result in suspension of your access and potential legal consequences.

15. Disclaimer of Warranties

Except as expressly stated in these Terms or required by applicable law, this website and our products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, so some or all of the above exclusions may not apply to you, and you may have additional statutory rights.

16. Limitation of Liability

To the fullest extent permitted by Illinois and U.S. federal law, we are not liable for any indirect, incidental, special, or consequential damages arising from the use of this website or the purchase of our products, and our total liability is limited to the amount you paid for your order. Some jurisdictions do not allow the limitation or exclusion of certain damages, so some or all of the above limitations may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

17. Force Majeure

We are not liable for delays or failures in performance caused by events beyond our reasonable control, including natural disasters, fires, labor disputes, carrier or postal disruptions, customs delays, pandemics, acts of government, or utility or internet outages. In such cases we will make reasonable efforts to fulfill or, where fulfillment is not possible, refund affected orders.

18. Dispute Resolution, Governing Law & Venue

These Terms are governed by the laws of the State of Illinois and applicable U.S. federal law. For customers in the United States, any legal action arising out of these Terms or your purchase shall be brought exclusively in the state or federal courts located in Illinois, and you consent to the jurisdiction of those courts.

If you are a consumer residing outside the United States, this choice of law and venue does not deprive you of the protection of mandatory consumer protection laws of your country of residence, and you may have the right to bring proceedings in the courts of your home country where required by law.

Before filing any claim, you agree to first contact us and give us a reasonable opportunity (at least 30 days) to resolve the dispute informally.

19. Changes to These Terms

We may update these Terms from time to time. The version posted on this website, with its effective date, applies to your order at the time you place it. Material changes will be indicated by updating the effective date above, and continued use of the website after changes are posted constitutes acceptance of the revised Terms.

20. Severability & Waiver

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later.
